General terms and conditions
Consumers Germany
§ 1 General Provisions
1) The following terms and conditions shall apply to all contracts concluded between Chr. Renz GmbH ("Renz") and consumers via the Renz Onlineshop store on www.renzwallbox.de, www.renz.com
2) A consumer within the meaning of these terms and conditions shall be any natural person who concludes a legal transaction for private purposes. An entrepreneur is any natural or legal person who, when concluding the legal transaction, is acting in its professional or commercial interest.
§ 2 Conclusion of the contract
1) The subject matter of the contract is the sale of goods, such as machines, equipment and consumables for consumers. The goods may be subject to change.
2) The presentation of the goods in the Onlineshop does not constitute a legally binding offer, but only an invitation to place an order.
3) All goods intended for purchase will be placed in the "shopping cart" by the customer. After entering the relevant personal data and payment information, the customer has the opportunity to check the information entered. By submitting the order by clicking on the button provided for this purpose, the customer places a binding order for the goods listed on the order page. The contract shall be concluded when Renz accepts the customer's order by sending an order confirmation by e-mail immediately after receipt of the order. In case of payment via payment service providers such as PayPal, the customer will be directed by Renz Onlineshop to the website of the provider. After entering all required data, the customer will finally be redirected to Renz Onlineshop.
4) The transmission of all information in connection with the conclusion of the contract shall be automated by e-mail. The customer shall therefore ensure that the e-mail address provided to Renz is correct and contactable.
§ 3 Retention of title and right of retention
1) The customer may only exercise a right of retention to the extent that the claim does not arise from the same contractual relationship.
2) Until full payment by the customer the goods shall remain the property of Renz.
§ 4 Liability provisions
1) Renz’ liability for personal injury and death, as well as for intent and gross negligence shall be unlimited. This shall also apply in case of fraudulent concealment of a defect and where prescribed by law.
2) Renz’ liability for slightly negligent breach of non-essential obligations in the contract is hereby excluded. For breach of essential contractual obligations Renz’ liability for slight negligence shall be limited to the foreseeable damage which is typical for this kind of contract.
3) Renz does not give any warranty for the uninterrupted availability of the website(s) and the goods offered hereon.
§ 5 Choice of law, place of jurisdiction
1) German law shall apply to the contract. The provisions of the UN Convention on Contracts for the International Sale of Goods shall not apply.
2) For disputes arising from the contractual relationship between the customer and Renz the place of jurisdiction shall be established in accordance with applicable laws.
§ 6 Dispute resolution
1) The European Commission provides a platform for the out-of-court settlement of disputes online (ODR platform), which is available at http://ec.europa.eu/odr.
§ 7 Contract language, contract text storage
1) English shall be the applicable language for the contract.
2) The complete contractual text of the General Terms and Conditions can be saved by the customer during the order process and can also be viewed on the Renz website(s).
§ 8 Prices and payment methods, features of the goods
1) The displayed prices and shipping costs are gross prices. Value added tax is shown separately from the net price. Renz reserves the right to change the prices of the goods offered and yet to be delivered. This shall not apply to already concluded purchase contracts.
2) Shipping costs are not included in the purchase price. They are displayed at the item description or displayed separately during the ordering process and are to be borne by the customer in addition to the purchase price, unless free delivery is confirmed by Renz.
3) The available payment methods are shown on our website(s) or as part of the respective item description, in any case at the latest at "checkout". Unless stated otherwise, payment for the goods is due immediately.
4) The essential features of the goods can be found in the item description and, where applicable, supplementary information on our website(s).
§ 9 Terms of delivery
1) Delivery conditions, delivery time and any delivery constraints can be found in the respective item description or in the agreed delivery schedules. The goods shall only be delivered within Germany.
2) For consumers, the risk of accidental loss or deterioration/damage to the goods during shipment shall not pass to the consumer until the goods are handed over to the customer. This provision applies regardless of whether the shipment is insured or uninsured.
3) No delivery shall be made on Sundays and public holidays. If the customer has ordered items with different delivery times, Renz shall send the goods in a single consignment unless otherwise agreed with the customer.
§ 10 Statutory Liability for defects
1) In respect of defects the statutory provisions shall apply.
2) The customer is requested to check the goods for completeness, obvious defects and transport damage upon delivery and to notify Renz as soon as possible. If the customer does not comply with this, this shall have no effect on his statutory warranty claims.
§ 11 Right of withdrawal
1) When ordering the goods, the customer is entitled to withdraw from the contract if he is a consumer. The following cancellation policy shall apply:
Cancellation policy
You have the right to withdraw from this contract without reason within fourteen days. The withdrawal period shall be fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods. To exercise your right of withdrawal, you must send us (Chr. Renz GmbH, Rechbergstraße 44, 73540 Heubach, Germany, Email: salesoffice@renz.com) your decision to withdraw from the contract by means of an express written notification (e.g. a letter sent by post or an email). You can use the enclosed model cancellation form, which is, however, not mandatory.
To comply with the withdrawal period, it is sufficient for you to send the notification exercising your right of withdrawal before the expiry of the withdrawal period.
Consequences of the withdrawal
If you withdraw from this contract, we will reimburse you all payments we received from you, including the delivery costs (with the exception of any additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received your notification of withdrawal. We will use the same means of payment for the reimbursement that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us (Chr. Renz GmbH, Rechbergstraße 44, 73540 Heubach, Germany) without undue delay and in any case no later than fourteen days from the day on which you notified us your withdrawal from the contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.
You shall bear the direct costs of returning the goods.
